Terms and conditions

Just a few things to make clear:

  1. The Songsmith warrants that any The Songsmith contribution to a song or poem is purpose-composed and not a recycled or stock melody, poem or lyric (unless explicitly specified as such). Your song or poem is unique.
  2. Although The Songsmith will take every care in ensuring that any CD-Rs provided are of the highest quality for long life and good readability, we cannot guarantee that they will play on every CD player - some older systems simply won't play CD-Rs properly. All The Songsmith CD-Rs must play correctly on The Songsmith test system.
  3. The Songsmith reserves the right to refuse any project without providing any reason for doing so. Usually this will be on the first consultation. Any progess payments to Songsmith will be fully refunded.
  4. Peter Haydon reserves all copyrights for any original material generated by The Songsmith, including the moral right to be known as the author of the work, and all mechanical reproduction copyrights. The Songsmith may reuse or reproduce any such material, and use it in advertising and other contexts, on the condition that reasonable attempts be made to protect the anonymity of the original commissioner and recipients.
    The commissioner and recipients of The Songsmith material have limited license to reproduce The Songsmith CDs (not including artwork) for friends and relatives, on the condition that this material is not sold, and on the further condition that the material is not published in mass media (including the internet, newspapers, bulk reproduction of CDs and the like) without the express and individual permission of the author. The copyright for any works which occur as a collaboration between The Songsmith and other artists will be determined by negotiation between The Songsmith and any other collaborators. By default, the entire copyright rest with The Songsmith.
